Crown Material Falling Outside the Scope of the PSI Licence

Copyrights not owned by the Crown
We cannot give permission to reproduce material where the copyright is not wholly owned by the Crown. Therefore, material that falls into the following categories falls outside the scope of the PSI Licence:
- Material which contains a statement that the copyright is held jointly by the Crown and another individual/organisation
- Material that features a statement that the copyright is owned by a person organisation other than the Crown.
- The original typographical arrangement of any Crown material which has not been published by the Crown, unless it is indicated in the work that the typographical arrangement rests with the Crown.
In these cases you will need to apply to the copyright owner(s) as indicated in the material.
Departmental logos
All Government departments have delegated authority to authorise the reproduction of their own department logos. Applications to reproduce departmental logos must be directed to the department concerned.
Material which is subject to security classification, legal and policy restrictions
You may not reproduce material which is subject to security classification, legal or policy restrictions. This includes personal identity documents such as driving licences and passports. Information for which an exemption from disclosure to the public could be claimed under sections 23-24 of the Freedom of Information Act 2000 also falls outside the scope of the PSI Licence. Exempt information in the Freedom of Information Act 2000 is summarised below:
- Information supplied by, or relating to, bodies dealing with security matters
- National security
- Certificates under ss. 23 and 24: supplementary provisions
- Defence
- International relations
- Relations within the United Kingdom
- The economy
- Investigations and proceedings conducted by public authorities
- Law enforcement
- Court records
- Audit functions
- Parliamentary privilege
- Formulation of government policy
- Prejudice to effective conduct of public affairs
- Communications with Her Majesty, and matters relating to honours
- Health and safety
- Environmental information
- Personal information
- Information provided in confidence
- Legal professional privilege
- Commercial interests
- Prohibitions on disclosure

The Royal Arms
The Royal Arms indicate that information issued by Government has official status. Therefore permission to reproduce them in non-official versions is not usually granted.
Where there is a need for departmental clearance
In cases where the information must be supplied to a Government department in a particular format, e.g. forms, or where the re-use of out of date information may mislead the public you will need to obtain permission from the relevant department before reproducing the material. This includes some information appearing on government websites which is subject to frequent change. It will be made clear when departmental clearance is required on those websites which fall into this category. Diagrams, technical drawings and other material which relate to wider intellectual property rights
Copyright material, including technical drawings and diagrams which relate to other forms of intellectual property rights in patents, trademarks, design rights, registered design rights and inventions. In the first instance you should apply to HMSO's Information Policy team and we will contact the appropriate department.
